Important Note for Travelers
Thank you for your interest in travelling with us. These Terms and Conditions apply to all international trips booked with Oba Tours. Review them carefully before completing your booking. Should you have any questions or concerns, our team is available to assist you.
1Definitions
refers to Oba Tours, a licensed tour operator registered under the laws of Ghana.
refers to any individual or group who books a tour, travel package, or associated service with the Company.
refers to any itinerary, excursion, safari, cultural tour, or travel arrangement organised by the Company.
refers to the confirmed reservation of a Tour Package by the Client.
refers to airlines, hotels, transport operators, guides, and any other independent service providers engaged by the Company.
refers to any event beyond the reasonable control of the Company, including acts of God, natural disasters, pandemics, civil unrest, war, governmental action, or strikes.
2Reservation and Payment
Reservations are accepted on a strict first-come, first-served basis. A booking is confirmed only upon receipt of the applicable deposit.
2.1 Deposit
2.2 Balance Payment
- Instalment Payments: The balance may be paid in agreed instalments. The final instalment must be received by Oba Tours no later than four (4) weeks prior to the scheduled departure date. A payment plan will be communicated to the Traveler upon confirmation of booking.
- Payment in Full: The Traveler may elect to pay the full trip cost at any time prior to the instalment deadline.
2.3 Payment Methods
2.4 USD Bank Transfer Charges
For all USD bank transfers, the following conditions apply:
- Transfers must be sent using the OUR option (sender pays all charges), ensuring that the sender bears the full cost of all international bank fees.
- An additional 7% of the transfer amount must be added to cover inflow charges applied by receiving banks in Ghana.
- For international wire transfers, an additional flat fee of USD 30 must be added to cover inflow processing charges.
- Any shortfall resulting from bank deductions will be treated as an outstanding balance and must be settled in full by the Traveler before travel commences.
2.5 Payment Plan Adherence
The Traveler is expected to honour all agreed payment milestones. In the event that a scheduled instalment cannot be met, the Traveler must contact Oba Tours promptly to discuss an alternative arrangement. Oba Tours reserves the right to cancel a reservation where payments are not received in accordance with the agreed plan and these Terms.
3Cancellation and Refund Policy
3.1 Cancellation by the Traveler
If a Traveler wishes to cancel a confirmed booking, written notice must be submitted by email to obatours.africa@gmail.com.
Note: Upon confirmation of a booking, Oba Tours proceeds to make direct and binding commitments with third-party providers (airlines, hotels, activity operators) on behalf of the Traveler. These bookings are made outright and may not always be recoverable. In the event of cancellation, the Traveler shall only be entitled to receive whatever amounts Oba Tours is able to recover from those third-party providers. The non-refundable deposit shall, in all circumstances, be forfeited and will not form part of any recovery.
Refund & Credit Windows (Excluding Deposit)
* Credits issued are valid for twelve (12) months from the date of issue and are non-transferable unless otherwise agreed in writing.
3.2 Booking Transfers
Oba Tours permits Travelers to transfer their booking to another eligible person at any point prior to departure. However, transfers may be subject to additional costs depending on the circumstances, such as:
- Visas or flight tickets that have already been issued in the Traveler's specific name, which may not be transferable and would require a fresh application or purchase;
- Gender-based room-sharing arrangements that may need to be restructured to accommodate the replacement Traveler, resulting in changes to room allocation.
Oba Tours will inform the Traveler of applicable charges before the transfer. It is the Traveler's sole responsibility to identify a suitable replacement. The substituted Traveler must meet all trip requirements and obtain approvals from third-party providers. Any fees imposed by third parties shall be borne by the Traveler.
3.3 Minimum Group Size and Trip Cancellation
Certain trips are subject to a minimum number of participants. Where the minimum group size is not met:
- Oba Tours will notify Travelers of the cancellation between thirty (30) and sixty (60) days before the scheduled departure date.
- All payments made will be refunded in full, including the deposit, or transferred as a credit toward an alternative trip at the Traveler's choice.
- Oba Tours shall not be liable for any independently incurred costs (e.g. flights, accommodation, or other travel arrangements outside the Oba Tours booking).
3.4 Cancellation by the Company
The Company reserves the right to cancel a tour due to: (a) insufficient participant numbers, or (b) Force Majeure events. If the Company cancels a tour for reasons other than Force Majeure, Clients will receive a full refund. In the case of a Force Majeure cancellation, the Company will endeavour to offer alternative dates or a credit note but shall not be liable for any further compensation.
3.5 No-Show Policy
Clients who fail to appear at the designated meeting point at the scheduled time without prior notice will be considered a no-show. No refund will be provided for no-shows.
3.6 Non-Refundable Third-Party Bookings
Where Oba Tours has made non-refundable commitments with third-party providers on the Traveler's behalf, any refund or credit shall be limited to amounts actually recoverable from those providers. Oba Tours shall not be liable for any portion of the payment that is non-recoverable from third parties.
4Changes and Amendments
4.1 Changes by the Client
Requests to change travel dates, itineraries, or accommodation after booking confirmation must be made in writing at least twenty-eight (28) days before departure. The Traveler shall be responsible for all costs, supplier charges, fare differences, visa-related costs, and administrative fees. Requests made within 28 days of departure will be treated as a cancellation, subject to Clause 3.
4.2 Changes by the Company
The Company reserves the right to make minor adjustments to itineraries, accommodation, or transportation necessitated by local conditions or safety concerns. We will provide equivalent or superior alternatives at no additional cost. Clients will be notified of any significant changes as soon as practicable.
5Visa, ETA Assistance, and Immigration
5.1 Assistance
Oba Tours may, upon request, provide assistance with visa and/or Electronic Travel Authorisation (ETA) applications. This service is provided as a courtesy and does not constitute a legal or immigration advisory service.
5.2 No Guarantee of Approval
Oba Tours does not guarantee the approval of any application. All decisions are made exclusively by the relevant authorities and are entirely beyond the control of Oba Tours.
5.3 Traveler's Responsibility
The Traveler bears sole responsibility for:
- Providing complete, accurate, and truthful information;
- Attending appointments or interviews as required;
- Meeting all deadlines and requirements;
- Applying for visas and ETAs sufficiently in advance.
5.4 Visa or ETA Denial, Delay, or Refusal
- The secure deposit remains non-refundable in all circumstances.
- Fees paid to Oba Tours for assistance are non-refundable once support has commenced.
- Refunds or credits for trip payments are governed by Clause 3 and limited to amounts recoverable from suppliers.
- If the refusal occurs more than 60 days before departure, any recoverable funds may, at our discretion, be issued as a credit toward a future trip, valid for 12 months.
- If refusal occurs within 60 days, no refunds shall be issued beyond amounts recoverable from suppliers.
- The Traveler must provide official written proof of visa or ETA refusal within five (5) working days.
6Traveler's Responsibilities
The Traveler shall, at all times during the booking process and throughout the trip:
- Arrive punctually at all designated meeting points;
- Obtain, maintain, and carry all necessary travel documents (valid passport, visa, ETA, and health certifications);
- Carry personal medication and required medical documentation;
- Ensure they are in good physical health and reasonably fit for the trip's activities;
- Take full responsibility for the safekeeping and supervision of their personal property;
- Conduct themselves in a manner that is respectful of fellow Travelers, staff, host communities, and local laws;
- Be financially prepared to cover personal medical expenses in the destination country.
7Limitation of Liability
7.1 Oba Tours shall not be held liable for any acts, omissions, negligence, or defaults of Third-Party Providers, including airlines, hotels, transport operators, or independent contractors.
7.2 The Traveler agrees to assume full personal responsibility for their own actions, conduct, health, physical wellbeing, and possessions.
7.3 Oba Tours shall not be liable for the loss of, or damage to, property, financial loss, or other damages suffered, except where directly caused by gross negligence or wilful misconduct of Oba Tours.
7.4 The Traveler is strongly encouraged to obtain comprehensive personal travel insurance covering medical evacuation, trip cancellation, visa denial, loss of baggage, and personal accidents.
7.5 In no event shall Oba Tours' total aggregate liability exceed the total amount paid by the Traveler to Oba Tours for the specific trip.
8Oba Tours' Responsibilities
Oba Tours undertakes to deliver all services described in the confirmed Itinerary with reasonable care, competence, and professionalism; to make all necessary travel arrangements, including transportation, accommodation, and scheduled activities; to take reasonable measures to ensure the safety and wellbeing of Travelers; and to maintain open and timely communication. Oba Tours and its representatives shall conduct themselves in a respectful and professional manner at all times.
9Intellectual Property and Image Consent
All materials produced or provided by Oba Tours remain the exclusive property of, or are duly licensed to, Oba Tours. By booking a trip, the Traveler consents to the use of their likeness, image, and/or voice in photographs or recordings taken during the trip for promotional or marketing purposes without compensation. Travelers who do not wish to be photographed or recorded must notify Oba Tours in writing before or at the commencement of the trip.
10Privacy and Data Protection
The Company collects and processes personal data in accordance with the Data Protection Act, 2012 (Act 843). Personal information provided at the time of booking will be used solely for the purpose of fulfilling the travel arrangements and will not be sold or shared with third parties except as required to deliver the services. Clients have the right to access, correct, or request the deletion of their personal data by contacting the Company in writing.
11Force Majeure
The Company shall not be in breach of these Terms, nor incur any liability, where the performance of its obligations is prevented or delayed by reason of any event beyond its reasonable control ("Force Majeure Event").
Force Majeure Events include, without limitation: acts of God, floods, earthquakes, fires, epidemics, pandemics, terrorist acts, wars, invasions, civil disturbances, riots, government restrictions, or strikes. Upon occurrence of a Force Majeure Event, the Company shall notify the Traveler as soon as practicable and use reasonable endeavours to minimise the impact. The Company shall not be responsible for any additional costs, losses, or expenses independently incurred by the Traveler.
12Miscellaneous
Oba Tours reserves the right to amend the Itinerary where necessitated by unforeseen circumstances. We will make reasonable efforts to provide comparable alternatives, and Oba Tours shall not be liable for any inconvenience or additional costs.
If any provision of this Agreement is held to be unlawful or unenforceable, that provision shall be severable without affecting the validity of the remaining provisions.
The parties shall endeavour to resolve any dispute amicably within fourteen (14) days. Where amicable resolution is not achieved, the parties are at liberty to pursue legal remedies under the laws of Ghana.
This Agreement, together with the confirmed Itinerary, constitutes the entire agreement. It supersedes all prior negotiations, representations, and discussions.
This Agreement shall be governed by and construed in accordance with the laws of the Republic of Ghana.
Acknowledgement & Acceptance
By making a booking, paying a deposit, or submitting a booking form, the Traveler confirms that they have read and fully understood these Terms and Conditions and agree to be bound by them.
